I, the undersigned, hereby acknowledge that I am voluntarily participating, myself and my dog, in dog training classes, consultations, and/or lessons and activities offered by K9 Optimal Training Solutions LLC. This release waiver is intended to shift the risk of participating in dog training to the Participant/Owner/Guardian of the dog participating in the training.

By signing, I acknowledge and certify that I have been informed and understand that there is always some unavoidable risk of injury, to myself and my dog, when working with animals, especially animals with behavioral issues. I understand that dogs can be difficult to handle, and there is a possibility of one being out of control, leading to an injury to myself, my dog, my family, or third parties.

I hereby accept and assume, without reservation, all risks associated with my participation in the Classes, including but not limited to: the risk of any and all injuries to myself, my dog, and any of my family members or third parties who may attend; the risk that my dog may cause injury to other persons and/or dogs involved in the classes.

As lawful consideration for participating in this training class/lesson, put on by K9 Optimal Training Solutions LLC and their trainers, I, for myself, my heirs, executors, administrators, legal representatives, successors, and assigns (the “Releasing Party”), hereby waive, release, discharge and agree not to sue and to indemnify, defend, and hold harmless K9 Optimal Training Solutions LLC, their members, owners, managers, agents, and employees (the “Released Party”) from any and all injuries, losses, claims, and damages to any person or persons of any nature—its directors, officers, employees, agents, sponsors, organizers, volunteers, or other representatives, their successors and/or assigns (hereinafter collectively the “Releases”)—from any and all liability to the Undersigned for any loss, harm, damage, claim, injury, or accident to the person or property of Undersigned, whether caused by any ordinary negligent act or omission of the Releases while the Undersigned or his/her dog is engaged in or participating in dog training or using Trainer or Business facilities in connection therewith.

I, undersigned, acknowledge that this releases K9 Optimal Training Solutions LLC and any of its members from any and all injuries, losses, claims, and damages to any person or persons of any nature whatsoever, including claims arising from the Released Party’s own negligence, and all costs associated therewith, including attorney’s fees, court costs, and consultant fees, arising from my participation in the class/lesson.

This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Should the Releasing Party assert a claim contrary to what I have agreed to in this Waiver of Liability & Informed Consent Release, the claiming party shall be liable for all expenses (including attorney’s fees, court costs, and consultation fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.

I hereby consent to my dog being the subject of photographs and/or audiovisual recording and authorize K9 Optimal Training Solutions LLC to cause the same to be exhibited for educational purposes or marketing tools as still photographs, video, or other similar media. This includes the use of these photographs, videos, or other media on social media.

Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable.

I, undersigned, agree to follow any and all instructions/guidelines given by K9 Optimal Training Solutions LLC while attending any class/lesson, and acknowledge that at any time, if they deem my actions or the actions of my dog to be dangerous or unruly, K9 Optimal Training Solutions LLC reserves the right to remove me from the class and future classes without refund of payment.

I, undersigned, understand and accept the responsibility for my dog and its actions both during and after classes/lessons with K9 Optimal Training Solutions LLC. I understand that in order for the dog to be successful in this training, I must also continue training at home between sessions and after.

I understand that K9 Optimal Training Solutions LLC has recommended types of equipment and tools to be used when training my dog, and will or have gone over the proper use of these tools, which I am voluntarily using. Therefore, any injury or death caused by the misuse of these tools is accepted by me, the undersigned, and K9 Optimal Training Solutions LLC is not liable for those injuries, damage, or death.

I, undersigned, agree that I will not use my dog trained by K9 Optimal Training Solutions LLC for any form of “dog fighting” or “pit fighting.” I understand that K9 Optimal Training Solutions LLC does not endorse or condone dog fighting or any form of animal abuse, and neither their training methods nor their purpose of training is meant to be used for this type of behavior. Any signs of animal abuse, dog fighting, or animal neglect seen by K9 Optimal Training Solutions LLC will be reported to the proper authorities and law enforcement.

I understand that I am responsible for any and all actions my dog does before, during, and after training sessions/classes with K9 Optimal Training Solutions LLC, including but not limited to biting another person, biting another dog, or causing any other damages of any kind to another participant or their dog in the class.

I have been made aware that in the event that my dog does bite a person or another dog during a training session—whether a member, agent, or any other party that represents K9 Optimal Training Solutions LLC or another participant in the class—K9 Optimal Training Solutions LLC will have to report it to the proper agencies.

I have been made aware and understand that any and all training done with my dog at K9 Optimal Training Solutions LLC is not guaranteed. I must continue the training outside of the class times and after my dog and I have completed all of the classes or sessions. This includes any and all behavioral issues that were or are addressed with my dog, including but not limited to aggression, jumping, nipping, or any other type of behavioral problem my dog may possess before, during, and after classes or sessions are finished.

No show/cancellation policy
If you miss a scheduled appointment or cancel without notifying the trainer within 24 hours, you will forfeit that training session without refund.
